Terms of Service

Welcome to faithed, a Christ-centered social networking platform. These Terms of Service ("Terms") govern your access to and use of faithed. By creating an account or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using faithed, you agree to:

• Comply with these Terms of Service
• Follow our Community Guidelines
• Respect our Privacy Policy
• Abide by all applicable laws and regulations

If you do not agree to these Terms, you may not use faithed.

2. Eligibility and Account Requirements

2.1 Age Requirements

• Minimum Age: You must be at least 13 years old to create an account
• Minors (13-17): Must have a Faith Guardian (see Section 2.3)
• Age Verification: We may request proof of age at any time

2.2 Account Creation

To create an account, you must:

• Provide accurate, complete, and current information
• Use your real name or a clearly identifiable variation
• Maintain one account per person (no duplicate accounts)
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized account access

2.3 Faith Guardian System (for Minors)

Users under 18 must designate a Faith Guardian who:

• Must be 18 years or older
• Can be a parent, legal guardian, church leader, or trusted adult
• Receives notifications about the minor's account activity
• Can report content or concerns to our moderation team
• Cannot access private messages or content in closed Faith Families

The Faith Guardian system automatically ends when the minor turns 18, though the adult user may choose to maintain the oversight relationship.

2.4 Account Restrictions

You may not create an account if you:

• Have been previously banned from faithed
• Are creating an account for someone else
• Intend to use the account for commercial spam or automated activity
• Are a registered sex offender (we run periodic background checks)

3. Content Standards and Community Guidelines

3.1 Your Content

You are solely responsible for content you post, including:

• Posts, comments, and replies
• Photos, videos, and media
• Profile information and bio
• Messages and Faith Family discussions

3.2 Prohibited Content

You may not post content that:

• Contains hate speech, harassment, or bullying
• Depicts or promotes violence, self-harm, or dangerous activities
• Contains sexual, pornographic, or inappropriate material
• Infringes on intellectual property rights
• Contains spam, scams, or fraudulent schemes
• Impersonates others or spreads misinformation
• Violates privacy or contains doxxing
• Promotes illegal activities or substances

3.3 Content Moderation

We reserve the right to:

• Review and remove content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal content to law enforcement
• Use automated systems and human moderators to enforce policies

We are not obligated to monitor all content but may do so at our discretion.

4. Intellectual Property Rights

4.1 Your Content License to Us

When you post content on faithed, you grant us a:

• Worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content
• Limited to: Operating, promoting, and improving the platform
• Sublicensable: Only to service providers necessary for platform operation

Important: You retain ownership of your content. This license only allows us to show your posts to other users and operate the platform effectively.

4.2 You Retain Ownership

You own all content you create and post. When you delete content:

• It is removed from public view immediately
• Copies in others' feeds may persist temporarily due to caching
• Backup copies may exist for up to 90 days
• Shared content (e.g., posts others screenshot) is outside our control

4.3 faithed's Intellectual Property

The faithed platform, including its design, features, and branding, is owned by faithed and protected by copyright, trademark, and other laws. You may not:

• Copy, modify, or distribute our code or design
• Use our name or logo without written permission
• Create derivative works or competing services
• Reverse engineer our systems

4.4 Third-Party Content

Content posted by other users belongs to them. You may not:

• Claim others' content as your own
• Use others' content commercially without permission
• Violate copyright when sharing third-party content (e.g., news articles, scripture must be cited)

5. Premium Subscriptions and Payments

5.1 Premium Features

faithed offers optional premium subscriptions with enhanced features:

• Ad-free experience
• Advanced privacy controls
• Priority support
• Exclusive content and faith resources
• Custom profile themes

5.2 Billing and Renewal

• Pricing: Current pricing is displayed on our Premium page
• Billing Cycle: Monthly or annual subscriptions
• Auto-Renewal: Subscriptions renew automatically unless cancelled
• Cancellation: Cancel anytime; access continues through paid period
• Price Changes: We will notify you 30 days before any price increase

5.3 Refunds

Premium subscriptions are generally non-refundable, except:

• If we terminate your account without cause (prorated refund)
• If required by Namibian consumer protection law
• If technical issues prevent access for more than 7 consecutive days

Refund requests must be submitted to [email protected] within 30 days.

5.4 Payment Methods

We accept major credit cards and alternative payment methods. You agree to:

• Provide accurate payment information
• Keep payment details current
• Authorize charges for selected subscription
• Pay any applicable taxes or fees

6. Account Suspension and Termination

6.1 Violations

We may suspend or terminate your account if you:

• Violate these Terms or Community Guidelines
• Engage in illegal activity
• Repeatedly post prohibited content
• Circumvent platform restrictions or bans
• Threaten the safety or security of other users

6.2 Suspension Process

Temporary Suspension (7-30 days):

• Issued for first-time or moderate violations
• You'll receive an email explaining the violation
• Access is restricted during suspension period
• Content remains but is hidden from public view

Permanent Termination:

• Issued for severe or repeated violations
• All content is removed
• You may not create a new account
• No refunds for premium subscriptions

6.3 Account Deletion (Your Choice)

You may delete your account at any time from Settings. When you delete your account:

• Your profile and posts are removed within 30 days
• Some data may be retained for legal or operational purposes (see Privacy Policy)
• Premium subscriptions are cancelled (no refund for current period)
• Your username may be made available to other users
• Some content may be retained for legal or operational purposes (see Privacy Policy)

6.4 Appeals

If you believe your account was suspended or terminated in error:

• Email [email protected] within 30 days
• Include your username and explanation
• We will review and respond within 14 business days
• Our decision on appeals is final

7. Disclaimers

7.1 "As Is" Service

faithed is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free service
• Warranties regarding the accuracy or reliability of content
• Warranties that the service will meet your requirements

7.2 No Guarantee of Uptime

While we strive for 99.9% uptime, we do not guarantee:

• Continuous, uninterrupted access to faithed
• Freedom from bugs or technical issues
• Compatibility with all devices or browsers
• That data loss will never occur

We recommend regularly exporting important content.

7.3 User Content Not Endorsed

Content posted by users does not represent the views of faithed. We:

• Do not endorse user opinions or theological positions
• Are not responsible for user content accuracy
• Do not verify credentials of users claiming ministry roles
• Cannot guarantee the authenticity of prayer requests or testimonies

7.4 Third-Party Links

faithed may contain links to third-party websites or services. We:

• Do not control or endorse third-party content
• Are not responsible for third-party privacy practices
• Do not guarantee the safety of external links
• Recommend reviewing third-party terms before use

7.5 Not Professional Advice

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY NAMIBIAN LAW, FAITHED AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or goodwill
• Service interruptions or data loss
• User content or conduct
• Unauthorized access to your account
• Third-party content or services

EVEN IF FAITHED HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

MAXIMUM LIABILITY: In any case, our total liability to you for all claims related to faithed shall not exceed the greater of:

• N$1,800 (Namibian Dollars), or
• The amount you paid to faithed in the 12 months before the claim arose

Exceptions: Some jurisdictions do not allow limitation of liability for certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Dispute Resolution

9.1 Informal Resolution

Before filing a claim, you agree to contact us at [email protected] to resolve the dispute informally. We commit to working in good faith to reach a mutually agreeable solution within 60 days.

9.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

You and faithed agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of faithed shall be resolved through binding arbitration under Namibian law, except as noted below.

Arbitration Process:

• Conducted in Windhoek, Khomas Region, Namibia or via videoconference
• Administered by a neutral arbitrator under Namibian arbitration rules
• Before a single neutral arbitrator
• Arbitrator's decision is final and binding

Costs: faithed will pay all arbitration fees for claims under N$180,000, unless the arbitrator finds your claim frivolous.

9.3 Exceptions to Arbitration

Either party may pursue claims in small claims court if they qualify under Namibian law. faithed may seek injunctive relief in court for intellectual property violations or to prevent irreparable harm.

9.4 Class Action Waiver

YOU AND FAITHED AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY.

You agree not to participate in class actions, class arbitrations, or representative actions. You may only seek relief on your own behalf.

Opt-Out: You may opt out of this arbitration agreement within 30 days of creating your account by emailing [email protected] with "Arbitration Opt-Out" in the subject line and including your full name and username.

9.5 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Namibia, without regard to its conflict of law provisions.

9.6 Venue

For any disputes not subject to arbitration, you agree to exclusive jurisdiction in the courts located in Windhoek, Khomas Region, Namibia.

10. General Terms

10.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and faithed.

10.2 Severability

If any provision of these Terms is found invalid or unenforceable under Namibian law, the remaining provisions will remain in full effect.

10.3 No Waiver

Our failure to enforce any right or provision in these Terms does not constitute a waiver of that right or provision.

10.4 Assignment

You may not assign or transfer these Terms or your account. We may assign our rights and obligations to any successor or affiliate.

10.5 Force Majeure

faithed is not liable for failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or government actions.

10.6 Survival

Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive termination of these Terms.

10.7 Language

These Terms are written in English. Any translated versions are provided for convenience only. In case of conflicts, the English version prevails.
